BOOKING TERMS & CONDITIONS

Our Flightpath Retreats, LLC travel products (“Experiences”) are governed by the following Terms & Conditions (“Terms”). By booking an Experience and placing a deposit, you acknowledge and agree to these Terms.

1. RELEASE & ASSUMPTION OF RISK

Participants acknowledge that travel and retreat activities involve inherent risks, including but not limited to:

  • Illness

  • Injury

  • Accidents

  • Transportation incidents

  • Weather-related events

  • Physical activities and excursions

  • Limited medical access, care and support

  • Differing weather conditions, altitudes and climates

  • Locations with higher rates of minor and/or violent crime than you have experienced before.

By participating, you voluntarily assume all risks associated with attendance and participation and agree to hold harmless Flightpath Retreats, LLC and its People from any liability, actions, causes of action, debts, claims, and demands of any kind which you now have or which may arise out of or in connection with the Experiences. These Terms are a release and assumption of risk for you, your family or heirs, and any executors and administrators. The Terms are in addition to any additional releases, waivers, limitations of liability, or assumptions of risk that you may sign. 

2. HEALTH & MEDICAL

Participants are responsible for determining whether an experience is suitable for their physical, emotional, and mental condition. By participating, you represent that:

  • You are physically able to participate in retreat activities.

  • You have disclosed any relevant medical conditions that may impact participation.

  • You assume responsibility for your own health and well-being during the retreat.

  • Have not been informed by any medical professional that you should not travel or participate in activities like those on the Experience;

  • Know of no physical or mental condition that would create a hazard for you or others, or affect other people’s enjoyment of the trip.

Flightpath Retreats, LLC does not provide medical services and is not responsible for medical treatment expenses incurred during participation. For this reason we strongly recommend that you obtain travel medical insurance.

3. BOOKING PAYMENT

Prompt payment is important not only to us, but also to our partners. Timely payment by our travelers allows us to reserve the best lodgings and ensure our partners are available for each Experience. Full payment must be made at least 60 days before your Experience’s start date.

For bookings made more than 60 days before the advertised start date of the Experience (“Start Date”), we require a non-refundable deposit of 50% of the total price of the Experience, at the time of booking. The remaining 50% is due no later than 60 days before the Start Date and is non-refundable. We reserve the right to cancel any booking, without refund, should the full amount not be paid at least 60 days before the Start Date.

For bookings made 60 days or less prior to the Start Date, we require full payment of the total price, less any applicable discounts, at the time of booking. Such payment is non-refundable.

4. CANCELLATION & CHANGES

Bookings are non-refundable. Because our partners make advance preparations and rely on confirmed attendance, we cannot permit cancellations or changes fewer than 60 days before your trip’s Start Date. This is why we strongly recommend travel insurance.

With at least 60 days' notice, you may change your booking and apply your deposit towards a future trip, one time at no charge. One additional change is permitted (provided it is also 60+ days before the rescheduled trip) for a $500 fee. No more than two changes are permitted per booking. After two changes, any remaining balance is non-refundable and ineligible for trip credit, regardless of notice given.

Trip credits may only be applied toward new group trip bookings. They cannot be applied to Final Payments on existing bookings, products, or any other Flightpath Retreats, LLC product or service.

If Flightpath Retreats, LLC cancels or changes your Start Date for any reason other than Force Majeure (see Section 9), you will receive a full refund of amounts paid. No refund is owed for cancellations or date changes due to a Force Majeure Event. Flightpath Retreats, LLC reserves the right to alter any itinerary or service in progress without penalty.

Flightpath Retreats, LLC may decline or cancel any booking at its sole discretion, including upon discovery of any breach of this Agreement.

Flightpath Retreats, LLC is not liable for any costs, fees, or losses related to your travel to or from the Experience due to itinerary cancellation or change. Travel insurance covering trip cancellation, interruption, and curtailment is strongly recommended.

5. TRAVEL INSURANCE & UNUSED SERVICES

Late flights, last-minute changes, sickness, or other unforeseen life events: they happen to all of us. But, because each booking is relied upon by our partners, we cannot offer any discounts, partial refunds, or full refunds for missed or unused Experiences. Flightpath Retreats, LLC is not obligated to alter,  suspend, change, or postpone an Experience; nor can we offer discounts or refunds. Travel insurance is a good way to minimize this risk.  We strongly recommend that you purchase it. Participants are strongly encouraged to purchase the below coverage for:

  • Personal Injury

  • Trip cancellation or interruption

  • Medical expenses

  • Emergency evacuation

  • Lost baggage

  • Travel delays

  • Personal property

Participants are responsible for obtaining their own insurance coverage. Flightpath Retreats, LLC is not liable for loss, theft of or damage to baggage or personal effects; nor are damaged, lost, or stolen personal belongings subject to reimbursement by Flightpath Retreats, LLC. Under no circumstances is Flightpath Retreats, LLC liable for loss or damage of valuables or other articles left in or on facilities used by Flightpath Retreats, LLC including, but not limited to, hotels, pensions, campsites, homestays, vessels, expedition vehicles, or any other location.

6. LIMITS ON RESPONSIBILITY

Costs associated with travel are your responsibility. You are responsible for booking, paying, and arranging for travel to and from the Experience. If Flightpath Retreats, LLC cancels or changes the Experience, it may cause you to incur some change fees or other related costs. Travel insurance may assist you in avoiding any such fees for trip cancellation, interruption, and curtailment. 

7. DRUG & ALCOHOL POLICY

While moderate alcohol consumption may be permitted during designated meals or free time, participants agree to consume alcohol responsibly and in a manner that does not negatively impact the safety or experience of themselves and other guests. By attending the retreat, participants acknowledge and agree that:

Any alcohol consumed during the retreat is done voluntarily and at the participant's own risk. Participants are responsible for understanding their own limits and making informed decisions regarding alcohol consumption.

Excessive intoxication, disruptive behavior, harassment, unsafe conduct, or behavior that interferes with retreat activities, staff, venue operations, or the experience of other participants will not be tolerated.

Retreat organizers reserve the right to prohibit participation in coaching sessions, excursions, wellness activities, transportation, or other scheduled events if a participant appears impaired or presents a safety concern.

Participants agree to comply with all applicable local laws, venue rules, and age restrictions related to alcohol consumption.

Participants assume full responsibility for any consequences arising from their alcohol consumption, including injury, illness, property damage, transportation issues, or conduct-related incidents.

Flightpath Retreats, LLC does not tolerate drug use of any kind during Experiences.

Retreat organizers reserve the right to remove any participant from activities or, in serious cases, require a participant to leave the retreat without refund if their alcohol or drug consumption results in unsafe, disruptive, or inappropriate behavior.

The retreat company, its owners, employees, contractors, facilitators, and partners shall not be liable for any injury, loss, damage, or claim arising from a participant's consumption of alcohol or drugs during the retreat.

8. AUTHORITY DURING EXPERIENCES

You agree to abide by the requests and authority of the trip leader or other Flightpath Retreats, LLC representatives at all times. Should you fail to do so, or, in the opinion of the trip leader or other Flightpath Retreats, LLC representatives, endanger, distress or annoy others, we may immediately terminate your Experience without a refund or other liability.

9. FORCE MAJEURE 

To the extent that any action by Flightpath Retreats, LLC is delayed or canceled due to a Force Majeure Event, Flightpath Retreats, LLC has not breached this agreement and is not responsible for any damage you may incur. Specifically, “Force Majeure Event” means any unforeseeable or unavoidable circumstances beyond Flightpath Retreats, LLC reasonable control, including without limitation acts of nature, terrorist activities, insurrection, explosion, flood, earthquake, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, civil disturbance, labor strikes, requisition, pandemics, sickness, quarantine, government intervention, weather conditions, and unforeseen circumstances.

If Flightpath Retreats, LLC or any vendor, supplier, or similar third party engaged by Flightpath Retreats, LLC are affected by a Force Majeure Event, Flightpath Retreats, LLC and any such third party is entitled to, and may in Flightpath Retreats, LLC’ sole discretion, vary or cancel any itinerary or arrangement in relation to the Experience without any obligation or liability.  

As explained above and in the context of such Force Majeure events, Flightpath Retreats, LLC is not responsible for performing its obligations and will not be responsible for any resulting damages.

10. SUPPLIERS’ CONDITIONS

Flightpath Retreats, LLC acts as an agent for transport companies, hotels and other partners and contractors (“Suppliers”) and is not responsible for any injury, damage, loss, delay or irregularity that may occur when using the products, services, or accommodations of a Supplier, or due to the negligence, recklessness, omission, oversight, inaction, or other fault of a Supplier, including, but not limited to, any defect in a vehicle or any other form of conveying a traveler, acts of God, detention, delays or expenses arising from quarantine, strike, riots, theft, civil disturbance, government restriction or regulation, accident by aircraft, boat, bicycle, motor vehicle or any other form of transport, or in any hotel or guest house, hostel, or other form of accommodation. 

The quality of the products, services, and accommodations organized by Flightpath Retreats, LLC are not within the control of Flightpath Retreats, LLC, and the quality of such products, services, and accommodations may be compromised by local conditions. You therefore release Flightpath Retreats, LLC from all claims and causes of action arising from any damage, loss of enjoyment, inconvenience, or injuries related to the quality of such products, accommodations, and services. 

Airlines, railways, car services, shipping companies, hotels, and other common carriers and suppliers have their own booking conditions or conditions of carriage. You will be bound by these conditions or conditions. Some of these conditions may limit or exclude liability on the part of the relevant transport provider or other Supplier, and they are often also subject to various international conventions. Flightpath Retreats, LLC’ own liability is limited to and shall not exceed that of its Suppliers. You agree that, if you recover for any damages from the Suppliers, you will not seek any recovery for the same damages from Flightpath Retreats, LLC.

11. OPTIONAL ACTIVITIES

You agree that Flightpath Retreats, LLC is not responsible for any optional activities outside of Flightpath Retreats, LLC’s Experience. Flightpath Retreats, LLC does not endorse or sponsor such activities and makes no representations about the safety or quality of such activities or the standard of the independent operators running them. Flightpath Retreats, LLC is in no way responsible for your safety should you decide to enter into such optional activities. If you still decide to enter into an optional activity, you assume full responsibility for any risks involved. Paragraph 1, Release & Assumption of Risk, will apply to any optional activities.

12. LIFE COACHING SERVICES & PARTICIPANT CONFIDENTIALITY

Experiences may include life coaching, personal development exercises, group discussions, and educational content. Life coaching is not therapy, counseling, medical treatment, mental health treatment, financial advice or legal advice. Flightpath Retreats, LLC makes no representations, warranties, or guarantees regarding the completeness, accuracy, suitability, effectiveness, or outcomes of any coaching services, materials, recommendations, discussions, or information provided before, during, or after the retreat. Participant acknowledges that all decisions, actions, and results arising from participation in coaching sessions or retreat activities are solely the Participant's responsibility. To the fullest extent permitted by law, Flightpath Retreats, LLC, its owners, employees, contractors, facilitators, coaches, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, losses, claims, costs, or expenses arising from or related to any errors, omissions, statements, recommendations, coaching guidance, participant interpretations, or decisions made in reliance upon information provided through the retreat or coaching services.

By participating in the retreat, you agree to honor the privacy and confidentiality of fellow participants. Participants agree to:

  • Respect the personal disclosures shared by others during the retreat.

  • Refrain from repeating, recording, publishing, or distributing another participant's personal information, stories, or identifying details without their explicit permission.

  • Maintain confidentiality regarding discussions that occur during coaching sessions, workshops, group circles, and other retreat activities.

  • Obtain consent before taking or sharing photographs, videos, or recordings that include other participants.

  • Contribute to a supportive, respectful, and judgment-free environment.

While Flightpath Retreats, LLC encourages all participants to maintain confidentiality, Flightpath Retreats, LLC cannot guarantee that all participants will do so. Each participant remains responsible for exercising discretion regarding the personal information they choose to share. Participants who engage in conduct that violates the privacy, safety, or trust of other participants may be removed from the retreat without refund at the sole discretion of Flightpath Retreats, LLC.

13. RELEASE OF LIABILITY

To the fullest extent permitted by law, participants release and hold harmless: Flightpath Retreats, LLC, its owners, employees, contractors, guides, coaches, venues, and partners from any claims, losses, damages, injuries, liabilities, costs, or expenses arising from participation in the retreat. This limitation does not apply where prohibited by law.

14. PHOTOGRAPHY & MEDIA USE

During the retreat, photographs, video, and other media may be captured. By participating, you grant Flightpath Retreats, LLC permission to use images or recordings that include your likeness for marketing, promotional, and educational purposes without compensation. Participants who prefer not to appear in marketing materials should notify Flightpath Retreats, LLC in writing before the retreat.

15. INTELLECTUAL PROPERTY

All retreat materials, worksheets, coaching frameworks, presentations, and related content remain the intellectual property of Flightpath Retreats, LLC. Participants may not reproduce, distribute, or commercially use Flightpath Retreats, LLC materials without written permission.

16. COMPLAINTS & CLAIMS

We value your feedback and want to make sure to provide the kind of positive, safe Experience our travelers have come to expect.

If You wish to make a claim, submit a complaint, or request compensation for any reason, you agree to do so via email (info@flightpathretreats.com) within 30 days of the Experience’s completion. Any and all supporting documentation to the claim or complaint must accompany the email. Only claims or complaints received by Flightpath Retreats, LLC within this timeframe will be considered. 

If any issues or questions arise during the Experience, you agree that you will promptly notify the trip leader or Flightpath Retreats, LLC representative or by email atinfo@flightpathretreats.com

17. SEVERABILITY

In the event that any term or condition contained in these Terms is held to be unenforceable or void by operation of law or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed from this Agreement or amended accordingly only to such extent necessary to allow all remaining terms and conditions in these Terms to survive and continue as binding.

18. SUCCESSORS & ASSIGNS

This Agreement will be to the benefit of and be binding upon Flightpath Retreats, LLC, You, and both parties’ respective heirs, legal personal representatives, successors and assigns.

19. ENTIRE AGREEMENT

This is the entire agreement between Flightpath Retreats, LLC and you as to any and all bookings, reservations, Experiences, trips, or transactions made with Flightpath Retreats, LLC, and constitutes a binding agreement. You agree that there are no verbal or written representations, warranties, collateral agreements, or terms or conditions other than as expressed in these Terms. 

20. GOVERNING LAW

These Terms shall be governed by and construed under the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Marin County, California.
